TORTURE: The Torture Tapes also prove that during the ordeal Sherry was screaming in obvious pain as a result of something being done to her by Staples. At one point Sherry screamed, "I can't stand it! U-h-h-h (gasping for breath)." Staples replied, "Well, I've got something else for you." Sherry responded in horror, "Nooooo! Pleeeease! Jeff, I beg you!" Staples then commenced to "adjust" the ropes, and Sherry cried out, "Oh! Please don't!" Throughout the hour of the assault captured on audio recordings Sherry continues to scream in agony and beg Staples to leave her alone. Staples denies that he tortured Sherry, claiming that he was adjusting the ropes out of compassion for Sherry and trying to make her more comfortable.
STAPLES' FALSE TESTIMONY: Staples changed his story numerous times on numerous issues. For example, Staples initially claimed that he committed the brutal, vicious acts he admitted to because Sherry had consumed a strong drink ashore, followed by three additional drinks on the Boundless within less than an hour. He claimed she'd then told him she was leaving him, and inexplicably began hitting him. Staples claimed that because of this, and the fact that Sherry had consumed these drinks in less than an hour, he felt he needed to restrain her.
LAWYERS' MISTAKE FORCED STAPLES A STEP CLOSER TO THE TRUTH: However, after Staples' attorneys inadvertently gave Sherry's attorney a copy of a timeline Staples had created but not intended to share with anyone but his defense lawyers, and which conflicted with his original story, Staples changed his false testimony.
Staples' timeline indicated that Sherry consumed three drinks total over a four hour period.
THE TRUTH: Sherry testified that after returning to the Boundless, Staples watched a movie while she sat at the Navigation table writing and drawing. When the movie ended, she told Staples that she had decided to leave him. When Staples tried to hug her in an effort to change her mind, she rebuffed him and called him a boring old man, and made other disparaging remarks about him. Staples went into a quiet rage. The events that followed will be detailed further in upcoming posts, but in summary, Staples hit Sherry and eventually threw her onto the bed and hog tied her. Sherry testified that when the assault began, she had consumed the equivalent of two and one half drinks over a 4-5 hour period.
Over the next few hours Staples kept Sherry hog tied and, at times, tied her to a 4 foot broom stick. He tied ropes across her mouth and placed a noose around her neck. He duct taped her mouth shut. At one point he untied her so she could use the bathroom, but when she tried to close the door, Staples yanked her off the toilet and retied her, leaving her underwear lying on the bathroom floor. Sherry testified that Staples later stuffed the underwear in her mouth to gag her. The bathroom incident left Sherry wearing only a thin tank top with spaghetti straps, and nothing else. The Torture Tapes show that while Sherry lay tied on the bed, naked except for the tank top, Staples laid on top of her and was sexually aroused. Sherry begged Staples to get off her. [Staples admitted that he laid on top of Sherry but claimed this was part of his attempt to protect his boat, himself or Sherry.]
Sherry believes that Staples was trying to punish her for the disparaging remarks she made to him and for leaving him. He wanted to hurt and and humiliate her. The assault ended hours later with Staples twice throwing Sherry violently to the deck of the yacht in the cockpit.
WHO BRAGS ABOUT BEING "VERY STRONG"? JEFF STAPLES:

This man, Jeff Staples, was 61 years old when the assault occurred, (now 67 or 68?) but he was as strong as an ox, proud of it and eager to prove it. In a 2008 online ad (attempting to lure female sailors after Sherry left him) he specifically bragged about being "very strong." That is one fact Sherry can confirm.
DUCT TAPE: When have you known anyone to have their mouth DUCT TAPED? I'm sure you'll agree that stories involving duct tape usually refer to rape, murder, torture, trunks of cars and dead bodies. Staples' use of duct tape to shut her mouth and a noose around Sherry's neck just proves the brutal and barbaric nature of the assault and belies his false claims of merely trying to protect her, himself or his boat. Duct taping a person's mouth shut is synonymous with evil intent.
Jeff Staples admitted that he duct taped Sherry's mouth but claimed he did so because she bit him. Sherry testified that he duct taped her mouth to keep her from screaming. Staples admitted that he duct taped Sherry's mouth after she was lying on the bed bound with ropes. Staples claimed that the duct tape had not kept her from biting. When asked how he finally managed to stop this alleged biting, he replied, "Moved my body."
This is not self defense. THIS IS NOT NORMAL BEHAVIOUR.
SAILBOUNDLESS CHARTERS: This post is in response to the alarming discovery that Jeff Staples is apparently operating Sailboundless Charters out of Goochland County,Virginia. Staples apparently sold the original Boundless, a 42 foot Island Packet and downsized to a 35 foot IP that he can pull on a trailer. Sherry, the author of this post, speaks as a survivor of a savage, brutal attack by Jeff Staples on the original Boundless.
WARNING: Make sure you know all the facts before you entrust your life and well being to anyone. Consider your safety. That point cannot be overemphasized.
WHY DIDN'T STAPLES CALL THE POLICE: As noted, Staples admitted that for hours he kept Sherry bound hand and foot, at times he hog tied her, tied her to a 4 foot broom stick, and he duct taped her mouth shut. According to the Torture Tapes, Staples had also tied rope across her mouth and a noose around her neck. Staples claimed his actions were necessary to stop Sherry from hurting him, his boat, or himself.
This happened while anchored near the shore in a harbour in Grenada, West Indies. St. Georges' Harbour was not an isolated anchorage. It hosted a full service marina and a yacht club, and was lined by a vibrant town. At the time of the attack the Boundless was equipped with a working Satelite phone, an SSB radio, more than one VHF radio, and two cell phones, one of which was a phone purchased specifically for use in the West Indies where the attack took place. There were also flare guns and loud horns with which to attract attention and summon help. If Staples had really believed such drastic measures were necessary to protect himself, his boat, and Sherry, one would expect that he would have summoned authorities immediately. He did not.
The Torture Tapes capture Sherry screaming in agony, begging and pleading for Staples to let her go or call the police. In fact, the Torture Tapes show that Sherry asked Staples to call the police more than 20 times in that one hour alone!
However, despite Sherry's pleadings, Staples steadfastly refused to call the police. Staples claimed he did not know how to call the police. He claimed he would do it later or in the morning. His true intent was revealed when he said he just didn't want to get the police involved in a domestic dispute. He claimed that police in Grenada wouldn't care about a domestic dispute. Clearly, he had no intention of ever calling them. He knew that Sherry was not intoxicated and was not violent. He knew that if the police came the only problem they would see was that Sherry had been tied and tortured. He was the one that would have some explaining to do, and he realized if the police came they would see that his actions were nothing more than a brutal attack brought on by Sherry's decision to leave Staples.
This, of course, is a common scenario in domestic violence--a woman decides to leave, and the man, who does not want the relationship to end, turns violent. That's why he didn't call the police. Clearly, it was Jeff Staples who feared them. On the other hand, Sherry clearly had nothing to fear by calling the police. She was not intoxicated or violent, not trying to harm Staples or his boat, and not trying to harm herself. She wanted--needed-- the police. That's why she repeatedly begged Staples to call them. But Staples refused.
This fact alone proves the true nature of Staples' conduct that night. In any given scenario, it is always the perpetrator who wants to avoid the police, and the victim who wants the police to come. That's the way it works. That's how it was in St. George's Harbour on January 28, 2008, when Jeff Staples refused to call the police.
The Torture Tapes prove that during at least the first two hours of the assault, Staples did not even attempt to call the police. Staples could not claim he did because the recordings proved unequivocally that he did not.
Conveniently, Staples claimed that once the recording stopped, he did try to call the police. He claims he tried, unsuccessfully, three times on the VHF radio. Sherry disputes this and testified that Staples never made any attempt to call the police the whole time she was bound. He admits he never tried to use the satellite phone or the cell phones. He never tried to set off an emergency flare or sound the horn to summon help.
If he was truly in such a dire situation that he was forced to bind Sherry in such a brutal manner, and even duct tape her mouth for his own protection, surely he could have found a way to summon help. Instead, he kept Sherry bound with ropes for hours, at times she was half naked on the bed, bound hand and foot, hog tied and tied to a four foot broom stick, with duct tape over her mouth. The resulting injuries required seven surgeries. What a compassionate guy, that Jeff Staples.
EVEN IF: Incidentally, even if Staples did attempt to call for help as he claimed, it is undisputed that he waited for at least two hours before allegedly doing so. A police officer who rightfully arrests someone cannot just handcuff them and toss them in the back seat for two hours, then decide to take them to the police station. Even if a citizen rightfully restrained an intruder in his home, he could not simply leave him tied up for a couple of hours, then decide to call authorities.
Does anyone believe that if your spouse or girlfriend, or anyone, for that matter, was acting violently (which was not the case here, but even if...) you could bind them hand and foot, toss them on the bed, tie them to a broom stick, duct tape their mouth, and leave them there for two hours without even attempting to summon authorities?
Even if Staples was initially justified in restraining Sherry (which he was not) he would have had a duty to summon authorities immediately. Being the skipper of a boat anchored just yards from shore in an inhabited harbor does not make you master of the universe. You're not the judge, jury and executioner. You're not at sea and you have no right to hold someone against their will. You just can't keep someone hog-tied and duct taped, tied to a broom stick, bound hand and foot for two hours, and refuse to call authorities, and claim you're doing it "for their own good." Well, unless you're Jeff Staples.
RESOURCEFUL: Note that, in his ad posted above, Jeff Staples claims to be "very resourceful." That is another claim Sherry can confirm, and she has no doubt whatsoever that if Staples had wanted to summon authorities, he could have done so. Make no mistake, Jeff Staples gets what he wants, whatever it takes. Staples wants people to believe that he is a qualified skipper because he is resourceful--he can find a way to get things done. Yet, curiously, he claimed that while anchored just yards from a marina, a yacht club and a vibrant shoreline, he was unable to find a way to summon help. Is this the person you want to entrust with your life?
STAPLES' STORY IS NOT LOGICAL: Staples claimed Sherry was intoxicated and trying to harm him or his boat, or herself. He has given vastly different stories regarding the events of that night, and his story is not only inconsistent with the contemporaneous tape recordings (the Torture Tapes), but it also defies logic. In his timeline (mentioned above), Jeff Staples indicated that hours into the ordeal, around 2:20 am, Sherry tried to escape through a hatch above the bed where she had been tied. Staples admitted that he pulled her back down and tied her up on the bed again. He claimed she was intoxicated and a danger to herself. Then, according to Staples' own timeline, just 30 minutes later, at 2:50, am, he decided to free her, and according to his deposition testimony, would have let her drive the motorized dinghy to shore at that time if she'd wanted to. How do you go from so drunk and dangerous I had to bind her hand and foot etc., then just 30 minutes later deem her safe to drive a motorized dinghy to shore?! You don't. It's simply not logical. That's because it's not true.
THE ACTS STAPLES ADMITTED TO SHOW A BRUTAL ASSAULT: This blog, when completed, will address the many interesting issues about what happened that fateful night, what happened at the police station in St. Vincent and the Grenadines, the false testimony given by the St. Vincent police, and what happened at the trial and beyond. In the meantime, suffice it to say that if you are somehow considering getting on a boat with Jeff Staples, you should be aware of the acts he has ADMITTED HE DID did to Sherry as well as the acts proved by the Torture Tapes. Hog tied? Tied to a broom stick? Noose? Rope across the mouth? Duct taped? Of a 51 year old woman nearly half your size?
JURIES DON'T ALWAYS GET IT RIGHT:
Don't let the trial outcome fool you!
Sometimes juries don't get it right. Sometimes the courts don't get it right. Sometimes it is due to incompetent counsel. In this case, Sherry's counsel failed to give the jury all of the information they needed to make an informed decision. Her attorney was not up to speed on the facts of the case. He was unprepared. Defense counsel ran circles around him because they were prepared.
In fact, before the trial, Sherry's attorney, Jim Thorsen (James Thorsen, of Marchant, Thorsen, Honey Baldwin and Meyer) contacted the Virginia State Bar in regard to some issues which created for him two potential conflicts of interest, and was advised that he could withdraw or obtain a written waiver from Sherry. He did neither. Sherry's counsel was not only unprepared, he was also frazzled and stressed out. Shortly before trial, he had a meltdown in front of defense counsel's office where he shoved Sherry and yelled and cursed at her,telling her to "shut the f*!&$ up!" Sherry believes that her attorney also failed to ensure that the jury was properly instructed on the law (more to be posted on this subject in the future).
In a gratifying coincidence, it appears that Staples' legal bills are matching up with Sherry's medical bills from the seven surgeries (on her shoulder, knee, wrist and elbow) she has undergone (three since the trial) and which her treating physicians directly relate to the assault by Jeff Staples.
CONSIDER THIS:
Michael Morton spend 25 years in prison for a crime he DID NOT COMMIT. The jury did not find him credible. He didn't say the right things, didn't act the right way. They were so sure they were right that they sentenced him to life in prison. But we now know they were WRONG. They believed the wrong people.
And here's an interesting case straight out of Goochland County: Michael Fuller threatened his wife and children and eventually held his children hostage, possibly even shooting at them before they were able to escape. Fuller ended up killing himself with his shotgun. Prior to this incident, according to the Richmond Times Dispatch, the wife had twice claimed he assaulted her. BUT, he was found not guilty on one charge and the other charge was dropped. One might wonder whether Goochland County got it wrong again, in finding that Fuller was NOT guilty of assaulting his wife, and electing not to prosecute him on the other charge. What does it take for Goochland County to find a successful businessman in the wrong? The facts of the "alleged" assaults are not clear, but in hindsight, it certainly seems fair to question whether this Goochland resident/violent abuser pulled one over on the Court system. Sherry can tell you for a fact that it can and did happen in her case. It is no wonder Jeff Staples' lawyers fought to have Staples' case moved OUT of Richmond and IN to Goochland county!

There was another case in Virginia where a trial judge believed a woman's allegations of rape despite the "rapists" protestations of innocence. It was a matter of credibility, and the trial court found the woman credible. The "rapist" was convicted and went to prison. Then the woman admitted she was lying. The "rapist" was in fact an innocent man. He was set free and the woman was convicted of perjury. The trial court had BELIEVED THE WRONG PERSON. The trial court judge had been so sure of the woman's credibility that he'd convicted the innocent man of RAPE and sent him to prison. Again, juries and judges do not always get it right.

Sometimes the facts do not come out clearly in court, or they are misunderstood. When you hear all of the evidence, including evidence that was not presented or argued to the jury, I am confident you will see that the story(s) told by Jeff Staples is not only inconsistent and illogical, it is not true. Regardless, the uncontested facts, admitted to by Jeff Staples, show an unbelievable use of force. I have heard many drunken sailor stories, but I have never heard of any other captain who hog tied, tied to a stick, tied rope across the mouth, tied a noose around the neck, and duct taped the mouth of any sailor, much less a 51 year old 105 pound sailoress. You have been warned.
Side Note:
CLAIM: As of this post, Jeff Staples' website states, "charter services began in 2007." That is simply a... well... let's just say that Staples NEVER chartered out the Boundless or any other boat from the time the Boundless was purchased in 2006 through at least May 2008. When you charter a boat, you reserve it for your own private use. Recruiting a crew member who pays his own expenses is not a charter! That crew member has "secured a berth" on a boat, not chartered it! In Staples' case, he needed extra crew members to help him with the Atlantic crossings in May 2007 and November 2007, and with the passage from the Caribbean to the US in May 2008. Staples took on some crew who agreed to pay their share of food and fuel. Staples received the extra manpower he needed and the crew member got more sailing experience. The crew is not considered a paying guest, but rather a working crew member. It appears that Jeff Staples is playing loose with the facts in order to lure unsuspecting customers.

No doubt Staples would argue that he did in fact have a Sailboundless website offering charters on the Boundless during 2007-2008. He would wiggle around his current claims by pointing out that he stated that chartering services had been OFFERED (not necessarily performed!) Blah blah blah. Not sure how he wriggles out of his claim that charter services were started in 2007. The bottom line is, Jeff Staples did not ever once charter out the Boundless or any other boat from the time Sherry met him in 2005 through 2007 and at least up to May 2008. I leave it to YOU to decide whether Staples is trying to pad his experience/credentials by leading potential customers think that he actually performed charter services during 2007.

Although Sherry cannot speak to Staples' activities following her departure from the Boundless in May 2008, please note the ad posted above in which Staples is seeking a female to sail with him on the Boundless, to Main, in June 2008. Clearly Staples was not offering charter services in this ad. Similarly, note the ad posted below where Staples was seeking crew for December 2007. Again, the ad is clearly not an ad for a yacht charter.
FACTS: In May 2007, Staples needed additional manpower to help in his first Atlantic crossing. He could not convince enough friends to join him on his first ocean crossing, so he put an ad on sailing forums for crew. As a result of his ads, two men paid $300 each for their share of expenses, to include food and fuel. That is not a charter, as Jeff Staples apparently wants you to believe. Is that how he operates? Does he want you to believe that he is more experienced in providing charter services than he actually is?
Sherry can tell you unequivocally that as of May 2008 Staples provided NO charters ever on the Boundless. Incidentally, on the initial crossing with the two paying crew noted above, the Boundless also had three other crew (in addition to Sherry), including her son, Danny. The other crew, Didier LaPierre, was a close friend of Staples. A third crew, Parker, was a friend of Staples' brother. Staples' intent was to charge each of them $300 for their share of food and fuel for a possible 30 day voyage. (Yes, that's what I said, he charged Sherry's son for food and fuel while serving as a crew member!) In the end, because Danny had picked up various items worth $300 for Staples prior to setting sail, they called it even. It is believed that a similar situation may have occurred with Didier LaPierre, and possibly Parker.
A different group of three crew also paid their own way during the 2007 Atlantic Rally for Cruisers [ARC]. Again, Jeff Staples advertised that the crew would be paying their share of expenses. On the last leg of the journey Staples again recruited crew who paid only their share of expenses. In the sailing world, this is not considered a "charter." It works like this: The boat needs a sailor and the sailor needs a boat. Some captains cover the sailor's food while on board, others require the sailor to contribute toward the costs. I'm pretty sure no one who sailed on the Boundless during that time frame, at least, would describe their experience as having "chartered" the Boundless!

I digress, but the point here is that Sherry believes that Staples' website is misleading, to say the least. There is a world of difference between accepting a crew who pays his own expenses, and "chartering" your boat. But then, why get bogged down with the truth! Again, check out the facts. Ask yourself whether Staples is trying to fool you, and if so, what else might he be misrepresenting.
Side Note 2: Besides the violence he inflicted on Sherry, there is the issue of competence/qualifications. Sherry cannot speak to his current credentials, but she can tell you that when the fateful journey that led to this assault occurred, Jeff Staples did not have a boat captains license. As far as she knows, he had no official sailing credentials other than relatively little experience. Staples seems to try to downplay his lack of professional credentials by directing attention to his pilot's license, although it is not clear why this would qualify him in the sailing arena. Generally speaking, it is a pilot's job to avoid mixing sailing with flying; he must keep the airplane in the air and out of the sea!
To Sherry's knowledge, Jeff Staples had taken a basic sailing course years earlier, then sailed a handful of boats he chartered from companies like SunSail. In May 2006 he sailed from Norfolk to St. Thomas as a crew member with a sailing school (with a licensed Captain). Then he purchased the original Boundless in October 2006. The shake down cruise on the Boundless took place in mid April 2007 and the year long voyage with Sherry, which included that first Atlantic crossing, began May 20, 2007. The voyage ended in May 2008.
Yes, the Boundless made it, but so did two teenagers who bought a few provisions, got on their sailboat, and set sail. They had trouble with meals because they'd not thought about can openers and cooking pots. Still, they made it across the Atlantic, from Deltaville to the Azores. It can happen, but living on luck is risky. If you are actually considering hiring this brutal man, Jeff Staples, I hope you are checking to see if he even has coverage on his boat to conduct it as a business. Does he have a boat captains licence? Anyone can buy a boat and put up a website. Check him out!!!
Again, all I can say is CHECK IT OUT. He claims to keep his boat in perfect working order, but Sherry's experience was not so.

The entire time that Sherry sailed on the Boundless, the shower pan in the main head on the Boundless was damaged, creating a real hardship for crew showering in that head. Jeff Staples would sit outside the head and repeatedly instruct the person in the shower to stop the water and run the drain pump. This process had to be repeated over and over while showering. It was never fixed while Sherry was on the boat. It would be interesting to know whether Staples ever fixed this problem and if not, whether he disclosed it to the lucky person who purchased the Boundless. Staples did not fix the problem during the time Sherry was on the Boundless because he had been told it would take a major financial outlay to repair.

Shortly after setting sail out of Deltaville in May 2007, headed for Gibraltar, the Boundless sprung a serious leak. Sherry believes it was a rusted plug or thru-hull of some sort--something Staples apparently should have checked out but didn't. He was able to fix the problem while underway, but Sherry's recollection is that this problem was related to the diesel heater on the yacht which then stopped working. The diesel heating system was not immediately repaired, and according to Sherry's best recollection, it may have finally been repaired shortly before the end of the voyage in May 2008, if at all.
The AIS did not work until the second half of the trip. It is Sherry's understanding that the real problem turned out to be that he just did not know how to install/operate the AIS.
The refrigerator/freezer did not function properly and required excessive defrosting operations.
In addition, Staples was very stingy with provisions for the crew, and would complain when Sherry fixed extra snacks for the crew on watch, even though the Boundless was well-provisioned. He would grumble and complain, stating that, "They've had enough to eat." Let's just say, a luxury cruise this was not.
Finally, a CHARTER on a 32 FOOT boat? That's pretty small for a charter boat. It is assumed that he's simply looking for a female to sail with or is offering only day sails. That is very small if you're talking about more than two people for any extended period of time, such as a sea voyage. The Island Packet is a well made, sturdy boat, especially suited for long ocean passages. However, the 42 foot Boundless was barely adequate for more than two people. Sherry has recently been sailing the Chesapeake Bay on a 47 foot Beneteau, another fine boat, and can only reiterate that 32 feet is very small. But that's beside the point--safety is the real issue.
The bottom line: Beware. Check out the claims made. There are reputable charter companies that have licensed captains, and can provide you with services, presumably without a skipper who has felt it "necessary" to bind and duct tape his 5' 2" 105 pound female crew member. Do you want a captain who could do this to YOU? A captain who DID do this to Sherry.
Trust me--when Jeff Staples says he runs a "tight" ship, he may be referring to his grip on his wallet or the noose around your neck.
SAFETY FIRST!!!!
FYI: As a final side note, Sherry has fought hard to keep the ordeal on the Boundless from destroying her soul and her love of sailing. She has made progress in that direction and has maintained connections to the sailing community and the sea. See photos below from 2012:
