Upon returning to Virginia, in May 2008, Sherry began seeing Dr. Paul T. McDermott and Dr. Wayne for injuries to her arms and wrists. She saw Dr. Kenneth Zaslav for her shoulder and knee. Dr. Wayne diagnosed "crush injuries."
WRIST: Dr. McDermott prescribed physical therapy and other conservative treatments for the pain Sherry had in both wrists. Then, in May 2010, after a positive MRI study, he performed laparascopic surgery on her left wrist. The surgery revealed a TFCC tear and missing cartilage from a portion of the wrist. Also discovered was a lot of debris associated with trauma. Dr. McDermott testified that these injuries were caused by the events described to him by Sherry; and further, he testified that the symptoms she had reported were consistent with the surgical findings.
RIGHT SHOULDER: Sherry testified that Staples twisted her arms behind her back as he tied her up, and she knew immediately he'd injured her shoulder. Surgery confirmed that Sherry had suffered two injuries to her shoulder, a SLAP tear and a rotator cuff tear. She had two surgeries to repair the damage. Sherry's treating physician testified at trial, relating the injuries to the assault.
RIGHT ELBOW: MRIs confirmed epicondylitis in both elbows. Surgery on the right elbow confirmed the epicondylitis and also revealed areas of missing cartilage in the joint. Sherry has had three surgeries to attempt to repair the damage done to her elbow from Staples' assault. Again, the treating physician related the injuries to the assault.
KNEE: Sherry testified that Staples dug his knee into her left calf as he attempted to tie her up. As she struggled to get away, she knew immediately she'd sustained an injury. This was also surgically confirmed and repaired, and related by her treating physicians to the assault.
